## 1. Parties and acceptance

These Terms (“Terms”) govern access to and use of the Obsidio Network software, websites, APIs, wallets, messenger, DEX, lending, launchpad, bridge interfaces, and related services (collectively, the “Services”) operated by the Obsidio project operators (“we”, “us”, “Operator”).

By accessing or using the Services you agree to these Terms. If you do not agree, do not use the Services.

## 2. Nature of the Services (mainnet / experimental)

2.1 Obsidio **mainnet** is live as of the Effective date above. The software remains **experimental** and post-quantum-oriented. Features may change without notice or fail.

2.2 There has been **no independent third-party security audit**. Internal review only — see `/docs/INTERNAL_AUDIT.md`. **Use at your own risk. Do not deposit funds you cannot afford to lose.**

2.3 **No guarantee of uptime, permanence of data, or recovery of assets.**

2.4 OBS on this mainnet deployment is the network’s native unit of account for fees, staking, and applications. The Operator makes **no promise** of market price, listing, or redeemability for fiat.

## 3. Eligibility

You must be at least **18** years old (or age of majority where you live) and not prohibited by applicable sanctions or law from using cryptographic software / virtual assets.

## 4. Your responsibilities

4.1 You are solely responsible for safeguarding private keys, seed phrases, API keys, devices, USB ceremony backups, and accounts.

4.2 You will not use the Services to violate law, launder money, evade sanctions, exploit minors, distribute malware, attack infrastructure, or infringe others’ rights.

4.3 You understand messenger (Fast / Private), DEX, lending, and bridge features may expose metadata to operators, peers, or public chain observers depending on mode.

## 5. Messenger

5.1 “Fast” mode is not end-to-end private against the operator path. “Private” mode uses ML-KEM sealing; metadata and timing may still leak.

5.2 We may retain limited logs for abuse / rate-limit enforcement as described in the Privacy Policy.

## 6. Financial / DeFi surfaces

DEX, launchpad, lending, bridge, and treasury interfaces are provided **as-is**. Consensus / FHE / application bugs may cause total loss. No insurance.

## 7. Intellectual property

Software is offered under licenses stated in the source repositories. OBSIDIO branding remains Operator’s.

## 8. No investment advice / no fiduciary duty

Nothing in the Services is investment, legal, or tax advice. We owe no fiduciary duty to users.

## 9. Disclaimers and limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES. OPERATOR’S AGGREGATE LIABILITY SHALL NOT EXCEED USD 100 OR THE AMOUNT YOU PAID US FOR THE SERVICES IN THE PRIOR 3 MONTHS (WHICHEVER IS GREATER). MANY JURISDICTIONS LIMIT SUCH EXCLUSIONS — YOUR RIGHTS MAY VARY.

## 10. Indemnity

You will indemnify Operator against claims arising from your use of the Services or violation of these Terms.

## 11. Governing law

See `/docs/JURISDICTION.md` (draft: Panama unless Operator publishes otherwise).

## 12. Changes

We may update these Terms by posting a new version on OBSIDIO.NETWORK. Continued use after posting constitutes acceptance.

## 13. Contact

Use the channels published on OBSIDIO.NETWORK (site footer / bounty).
